Seeking legal advice for personal injury resulting from a boating accident in Boston Harbor

Additional Information:

My sister suffered from a pretty bad injury to head and neck after a boating accident in Boston harbor.  She was riding as a guest when her boat collided with another boat driven by a stranger. With this type of injury are the laws any different?  Do we do anything different other than talking to a personal injury lawyer?

ATTORNEY ANSWER:

Yes, we suggest you consult with an attorney who practices not only personal injury law, but maritime or what is known as Admiralty law as well.  Although a boating accident does have many things in common with a car accident or a slip and fall, there may be significant differences.

For example, the “status” of the person aboard the boat or vessel–non-paying passenger, paying passenger or crew member–may trigger different time limitations in which a formal lawsuit must be brought, the types and amounts of money damages that may be sought, etc.  Further, marine insurance differs from land based insurance.  Under some circumstances, a recreational boat owner’s homeowner’s insurance may provide coverage for a boating accident. An Admiralty lawyer will also explore other possible avenues such as whether a products liability case may be brought against the boat manufacturer if the design of the boat either contributed or made the injuries worse.  So, yes you should talk to a maritime personal injury lawyer for this type of accident.
